Terms and Conditions for Dr. Ash Ranpura Consultation Prize Draw

These are the legal terms that apply to the Dr. Ash Ranpura Consultation Prize Draw (the "Prize Draw").

first direct, a division of HSBC UK Bank plc of 1 Centenary Square, Birmingham, B1 1HQ, United Kingdom, is the “Promoter” of this Prize Draw.

 

1. Can I enter the Prize Draw?

To enter the Prize Draw, you must:

a)  be resident in England, Wales or Scotland;

b)  be aged 18 years or over;

c)  be a first direct 1st Account customer

d)  not work for the Promoter and not have been involved in setting up or running this Prize Draw;

e)  not have already entered the Prize Draw;

f)   not be entering the Prize draw for someone else; and

g)  have completed the Money Types Quiz and been notified of your money type.

If you don’t meet or stop meeting any of these criteria after entering the Prize Draw, then you may be disqualified and any prize you may have won will be forfeited. 

 

2. How do I enter the Prize Draw?

You can enter the Prize Draw from [00:01] GMT on 17 September 2021 until [23:59] GMT on 26 September 2021. All entries received after the closing date are automatically disqualified. 

To enter the Prize Draw, take the Money Types Quiz by following the link in the Money Types email addressed to you, you received from first direct. Once you know your individual money type, you need to select “Enter Now” in the email and this will register your entry.

There is no purchase or entry fee to enter the Prize Draw.

By entering the Prize Draw, you are agreeing to be bound by these Terms and Conditions.

 

3. What are the Prizes?

Each winner of the Prize Draw will receive a one to one workshop with Dr. Ash Ranpura to discuss your money type and what that means in more detail. The value of each prize is £500. There are 5 prizes available.

All prizes are subject to availability.

All entrants who win the prize are referred to as the “Winners”, each a “Winner”.

The Winners will also be responsible for any tax liabilities.

If the prize offered is unavailable due to circumstances beyond the control of the Promoter, the Promoter can offer an alternative prize of equal or greater value at the Promoter’s discretion.

There is no cash alternative and the prize can’t be transferred or exchanged.

 

4. How are the Winners selected?

The Winners will be picked at random at 12:00 GMT on 28 September 2021. The Promoter will try to contact the Winners via email within 30 days of the Prize Draw closing.

Prizes which are not claimed by 10 October 2021 will be forfeited. The Promoter reserves the right to pick an alternative winner if a prize is not claimed.

The odds of winning will depend on the total number of valid entries received.

 

5. How can you find out the names of the Winners?

To find out names of the Winners, or if you have any questions about the Prize Draw please send an email to fdcompetition@firstdirect.com.

 

6. What else do you need to know? Legal Information

The Winners agree to take part and allow their name and location to be used in any promotional activities reasonably requested by the Promoter.

The Promoter and its group companies and contractors will not be liable (to the extent permitted by law) for any loss or damage arising out of organising or holding this Prize Draw or as a result of your participation in the Prize Draw, unless the loss or damage is caused by the negligence of the Promoter or its group companies or its contractors, including without limitation in relation to:

  • any lost, stolen, delayed, damaged or incorrect entries;
  • any errors, interruptions, delays in operation or transmission, line failure, theft or destruction of entries;
  • the use or enjoyment of any prize; or
  • if the Prize Draw does not run as planned.

This clause does not seek to exclude the liability of the Promoter and its group companies and contractors for (a) death or personal injury caused by the Promoter and its group companies’ and contractors’ negligence, (b) fraud or fraudulent misrepresentation, and/or (c) any other matter for which it would be unlawful for the Promoter and its group companies and contractors to exclude or attempt to exclude their liability. Your statutory rights are not affected.

The Promoter reserves the right to amend these Terms and Conditions or cancel the Prize Draw (or any part of it) without notice if required by law or due to reasons beyond the Promoter’s reasonable control. The Promoter also reserves the right to cancel the Prize Draw or amend these Terms and Conditions for a specific reason where it’s reasonable or valid to do so.

The Promoter shall not be responsible for any Terms and Conditions issued by the manufacturer or issuer of any prize nor the Winners’ compliance with them.

The laws of England & Wales apply to this agreement and you can bring legal proceedings in respect of this agreement in the courts of England & Wales. If you live in Scotland you can bring legal proceedings in respect of this agreement in either the Scottish or the English & Welsh courts. If proceedings are brought in the Scottish courts, the laws of Scotland apply to this agreement and not the laws of England & Wales.

 

7.     What about any intellectual property rights?

You agree that the Promoter may, but is not required to, make your entry available on its website and any other media, and in connection with any publicity of the competition.

To the extent that your entry is the subject of any intellectual property rights (for example copyright in a photograph), you hereby grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for any purpose. You hereby waive your moral rights in your entry (including the right to be credited as the author of the works).

You warrant that your entry is your own original work, that you own the intellectual property rights in your entry and that your entry does not infringe the intellectual property rights of any third party. 

 

8.     Your Personal information

Any personal information entrants provide will be processed by the Promoter, and used to run the Prize Draw and to administer the fulfilment of the prizes. Personal data may be stored and processed in the United Kingdom or overseas (which includes outside of the European Economic Area), by the Promoter or HSBC or other parties on the Promoter’s or HSBC’s behalf for the purpose of administering this Prize Draw.
